Panafrican.email Email Service Agreement & Acceptable Use Policy

This Email Service Agreement and Acceptable Use Policy (“Email Agreement”) governs the purchase, activation, access, and use of email accounts and related communication services provided by Panafrican.email.

By purchasing, activating, accessing, or using a Panafrican.email email account, you acknowledge that you have read and agree to this Email Agreement, our Terms and Conditions, and our Privacy Policy.

If you do not agree with this Email Agreement, you must not purchase, activate, or use a Panafrican.email email service.

2. Description of the Email Service

Panafrican.email may provide hosted email accounts using the Panafrican.email domain, together with related services such as mailbox storage, webmail access, email delivery, email receiving, spam filtering, authentication, and technical support.

Specific features, storage limits, mailbox limits, account limits, and other technical specifications may vary according to the email plan purchased.

We reserve the right to modify or improve the technical features of the service provided that such changes do not materially eliminate the core service purchased by the customer.

3. Eligibility

You must provide accurate and complete information when creating an email account.

If you create an account on behalf of a company, organization, or other entity, you represent that you are authorized to act on behalf of that entity.

You may not create an email account using false identity information, impersonate another person or organization, or create accounts for fraudulent purposes.

4. Account Ownership and Credentials

You are responsible for maintaining the confidentiality of your email address, password, authentication credentials, and other account information.

You are responsible for all activity conducted through your account unless you can demonstrate that the activity occurred without your authorization and despite reasonable security precautions.

You must immediately notify Panafrican.email if you believe your account has been compromised, accessed without authorization, or used for abusive activity.

5. Acceptable Use

Panafrican.email email accounts are provided for legitimate personal, professional, business, organizational, educational, or other lawful communication.

You agree to use the service responsibly and in accordance with applicable laws, regulations, these Terms, and generally accepted standards for electronic communications.

6. Prohibited Activities

You may not use a Panafrican.email account to conduct, facilitate, promote, or assist in unlawful or abusive activity.

Prohibited activities include, but are not limited to:

  • Sending unsolicited bulk email or spam.
  • Operating unauthorized mailing lists.
  • Sending phishing messages or fraudulent communications.
  • Attempting to obtain passwords, financial information, authentication codes, or other sensitive information through deception.
  • Distributing malware, ransomware, viruses, spyware, or other malicious software.
  • Attempting to compromise or gain unauthorized access to computer systems, networks, servers, or accounts.
  • Using the service to conduct scams, fraud, identity theft, or impersonation.
  • Sending messages designed to harass, threaten, intimidate, or unlawfully harm another person.
  • Using email accounts to distribute content that violates applicable law.
  • Creating accounts for the purpose of bypassing restrictions imposed on another account.
  • Using compromised accounts, stolen credentials, or unauthorized identities.
  • Using the service to facilitate unlawful financial transactions or deceptive commercial activity.
  • Attempting to interfere with the operation, security, or reputation of Panafrican.email.

7. Spam and Bulk Email

Panafrican.email maintains a strict policy against spam and abusive bulk email.

You may not use your Panafrican.email account to send unsolicited commercial email, mass unsolicited messages, purchased email lists, harvested email lists, or other communications that violate applicable anti-spam laws or regulations.

Legitimate newsletters and mailing campaigns must be conducted using appropriate consent-based practices and applicable email marketing requirements.

Panafrican.email may impose additional sending limits or requirements on accounts that send high volumes of messages.

8. Phishing, Fraud, and Impersonation

You may not use a Panafrican.email account to impersonate another person, company, government agency, financial institution, organization, or other entity for deceptive purposes.

Phishing, credential harvesting, fraudulent payment requests, fake invoices, investment scams, identity theft, and similar activities are strictly prohibited.

9. Malware and Security Abuse

You may not use Panafrican.email to distribute malicious software, harmful attachments, malicious links, exploit code, ransomware, spyware, or other material intended to compromise another person’s device, account, network, or system.

Attempts to circumvent security controls, authentication systems, spam protections, rate limits, or other technical safeguards are prohibited.

10. Email Content

You are responsible for the content of messages sent through your Panafrican.email account.

Panafrican.email does not generally review the contents of private communications for editorial purposes. However, we may take reasonable action when necessary to investigate security incidents, abuse reports, violations of this Email Agreement, threats to the service, or legal obligations.

11. Privacy of Email Communications

Panafrican.email respects the privacy of email communications.

Information relating to email accounts and services may be processed as described in our Privacy Policy.

We may access or disclose information when reasonably necessary to comply with applicable law, respond to lawful legal process, protect users or the public, investigate security incidents, prevent abuse, enforce this Agreement, or protect the rights and security of Panafrican.email and its users.

12. Email Storage

Each email plan may include specific storage limits and technical restrictions.

Customers are responsible for monitoring their mailbox storage and maintaining appropriate copies or backups of important communications and files.

Panafrican.email does not guarantee that deleted, corrupted, lost, or inaccessible email messages can always be recovered.

13. Attachments and File Storage

Email attachments may be subject to size, file-type, security, or storage limitations.

We may restrict or block attachments or links that present a security, malware, spam, or operational risk.

14. Account Security

You are responsible for using a strong password and taking reasonable steps to protect your account.

We may require password changes, additional authentication, account verification, or other security measures when reasonably necessary to protect an account or the service.

15. Service Availability

We aim to provide reliable email services but cannot guarantee uninterrupted or error-free service.

Service interruptions may occur because of maintenance, upgrades, infrastructure failures, Internet or network problems, security incidents, third-party infrastructure, force majeure events, or circumstances outside our reasonable control.

Where reasonably practical, we may provide notice of planned maintenance that is expected to materially affect service availability.

16. Third-Party Infrastructure

Panafrican.email may use third-party infrastructure providers to support hosting, mail servers, storage, DNS, spam filtering, security, authentication, backups, webmail, network connectivity, or other technical functions.

Third-party infrastructure may change as we improve or expand the service.

Customers agree that Panafrican.email may use appropriate third-party infrastructure providers to deliver the email service.

17. Email Delivery

Panafrican.email does not guarantee that every message sent from or to a Panafrican.email account will be delivered successfully or immediately.

Email delivery may be affected by recipient-server policies, spam filtering, DNS configuration, Internet outages, reputation systems, temporary service failures, message content, attachment size, or other factors outside our control.

18. Domain and Email Address Rights

Email addresses provided through Panafrican.email are part of the Panafrican.email email service and do not automatically transfer ownership of the Panafrican.email domain to the customer.

Customers may not represent a Panafrican.email email address or domain as independently owned by them unless they have received written authorization to do so.

19. Business and Organization Accounts

Businesses, nonprofits, organizations, educational institutions, and other entities may purchase multiple email accounts or related services.

The organization purchasing or administering the accounts may be responsible for managing its users, account permissions, passwords, employee access, and internal policies.

Organizations are responsible for ensuring that their use of the service complies with applicable laws and regulations.

20. Administrative Access

Where an organization purchases an email service that includes administrative controls, designated administrators may be able to create, modify, suspend, or remove user accounts in accordance with the organization’s subscription and service configuration.

Organizations are responsible for informing their users of applicable internal policies regarding organizational email accounts.

21. Account Suspension

Panafrican.email may temporarily suspend an account when reasonably necessary to:

  • Protect the security of the account or network.
  • Investigate suspected abuse or unauthorized access.
  • Address spam or malicious activity.
  • Prevent harm to other users or third parties.
  • Address non-payment.
  • Comply with applicable law or lawful requests.
  • Enforce this Email Agreement.

Where reasonably possible, we may provide notice and an opportunity to resolve the issue before taking action. Immediate action may be taken where necessary to protect users, systems, networks, or third parties.

22. Account Termination

An email service may be terminated by the customer or by Panafrican.email in accordance with the applicable service terms.

Upon termination, access to the associated mailbox may be disabled and stored email data may eventually be deleted in accordance with applicable retention procedures.

Customers are responsible for exporting or transferring important information before an account is terminated.

23. Non-Payment

Paid email services must be maintained in accordance with the applicable billing terms.

If payment is not received when due, Panafrican.email may restrict, suspend, or terminate the affected service after any applicable notice period.

Applicable reactivation, recovery, or administrative fees may apply where disclosed in the applicable service terms.

24. Prohibited Commercial Practices

You may not use a Panafrican.email account to conduct deceptive commercial practices, fraudulent sales, fake investment offers, fraudulent invoices, payment scams, pyramid schemes, or other unlawful commercial activity.

25. Reporting Abuse

If you receive spam, phishing, fraudulent messages, malware, threats, or other abusive communications originating from a Panafrican.email address, please report the matter to Panafrican.email.

Abuse reports should include sufficient information for us to investigate, such as the sender’s email address, relevant message information, dates, and a description of the suspected abuse.

26. Cooperation With Investigations

Panafrican.email may investigate credible reports of abuse, security incidents, fraud, spam, unauthorized access, or violations of this Agreement.

Where legally permitted and reasonably necessary, we may preserve or disclose relevant information in response to lawful requests or to protect the security and integrity of our services.

27. Backups and Data Recovery

We may maintain backups or other recovery mechanisms as part of our infrastructure. However, backups are not a guarantee that every email, attachment, account, or piece of data can be recovered after deletion, corruption, hardware failure, service interruption, or other event.

Customers should maintain their own backups of information that is important to them.

28. Customer Responsibilities

Customers are responsible for:

  • Providing accurate account information.
  • Protecting account credentials.
  • Using the service lawfully.
  • Keeping mailbox storage within applicable limits.
  • Maintaining appropriate backups of important information.
  • Monitoring account activity for unauthorized access.
  • Responding promptly to security or abuse notices.
  • Paying applicable service fees.
  • Ensuring that their users comply with this Agreement.

29. Intellectual Property

The Panafrican.email name, branding, domain, website, software interfaces, service materials, documentation, and other proprietary materials are protected by applicable intellectual-property laws.

Use of the email service does not grant the customer ownership of Panafrican.email intellectual property.

30. No Resale Without Authorization

Customers may not resell, sublicense, redistribute, or commercially provide Panafrican.email email services to third parties unless expressly authorized by Panafrican.email in writing.

31. Disclaimer of Warranties

To the maximum extent permitted by applicable law, Panafrican.email email services are provided on an “as is” and “as available” basis.

We do not guarantee uninterrupted service, complete security, error-free operation, immediate delivery, permanent availability of stored messages, or delivery to every recipient.

32. Limitation of Liability

To the maximum extent permitted by applicable law, Panafrican.email and its owners, employees, contractors, contributors, service providers, and partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to the use or inability to use the email service.

This may include loss of data, loss of business, loss of profits, loss of communications, service interruption, or other intangible losses, except where liability cannot legally be excluded or limited.

33. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Panafrican.email and its owners, employees, contractors, service providers, and partners from claims, damages, liabilities, losses, costs, and expenses arising from your unlawful use of the service, violation of this Agreement, infringement of another person’s rights, or content transmitted through your account.

34. Changes to the Email Service

We may update, modify, replace, or discontinue particular features of the email service as technology, security requirements, infrastructure, or business needs change.

Where required by applicable law or contractual obligations, we will provide appropriate notice of material changes.

35. Governing Law

This Email Agreement shall be interpreted and governed by applicable law, subject to any mandatory consumer protections or other legal rights that apply to you.

36. Severability

If any provision of this Email Agreement is found to be invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

37. Entire Agreement

This Email Agreement, together with the Panafrican.email Terms and Conditions, Privacy Policy, applicable service plan, and any additional written agreement between Panafrican.email and the customer, constitutes the agreement governing the customer’s use of the email service.
